WHAT IS MEDIATION?

Mediation is a process by which parties resolve their disputes outside of court with the help of a trained mediator who encourages all sides to work together to find mutually acceptable solutions.
 
Mediation lacks the formality and rigidity of court proceedings. No evidence is presented and no witnesses are called.
 
Mediation eliminates the risk, uncertainty and expense of court and allows the parties to retain all of the decision making power.
 
Mediation provides an opportunity for parties to resolve claims and disputes in a neutral, safe and comfortable setting wherein they set the duration of the mediation. In fact, parties are often afforded far more time in mediation than they may otherwise have in court.
 
The mediator is neutral in the process and does not take sides. The mediator does not serve as judge. The mediator serves to facilitate communication, compromise and resolution of disputes.
